Abstract
En el Ecuador el inciso segundo del artículo 4 del Código Orgánico Integral Penal, sobre la prohibición de hacinamiento ha sido inobservada e ineficaz pues en la actualidad en el Centro de Rehabilitación Social de Tulcán, no cuenta con la infraestructura, celdas, colchones, trabajo, salud y actividades de resocialización adecuadas para la titularidad de los derechos humanos de las mujeres privadas de libertad, pues las condiciones en que se encuentran actualmente demuestran que existe una sobrepoblación de casi 105 mujeres cuando la capacidad para recibir es solo de 95 mujeres a nivel de la infraestructura del Centro Penitenciario, como de servicios básicos, pues las políticas públicas para cumplir con la finalidad del sistema penitenciario se encuentran limitadas, debido al bajo presupuesto, la crisis carcelaria, el aumento de la delincuencia y la falta de atención a esta problemática, determinando que el cumplimiento normativo, no es eficaz, en razón del objetivo general de la presente investigación. En la actualidad las mujeres privadas de libertad son un grupo con doble vulnerabilidad de acuerdo a lo establecido por la Constitución de la República del Ecuador, al ser parte de un grupo de atención prioritaria y al garantizarse una igualdad de género en la que la mujer durante décadas ha debido luchar, por lo cual incluso a nivel carcelario han sido pocos los estudios que hablan sobre la realidad en la que se encuentran dentro del sistema de ejecución de penas, por lo que el Estado y las autoridades deben coordinar una solución viable y sanciones para quienes inobserven la capacidad máxima permitida para el ingreso de mujeres a los centros privativos de libertad y así no afectar la titularidad de sus derechos, permitiendo así una adecuada rehabilitación, resocialización y reinserción.
In Ecuador, the second paragraph of article 4 of the Organic Comprehensive Criminal Code, on the prohibition of overcrowding, has been unobserved and ineffective, since currently the Tulcán Social Rehabilitation Center does not have the infrastructure, cells, mattresses, work, adequate health and resocialization activities for the entitlement of the human rights of women deprived of liberty, since the conditions in which they currently find themselves show that there is an overpopulation of almost 105 women because the capacity to receive is only 95 women that the center has both at the level of infrastructure and basic services, since public policies to fulfill the purpose of the prison system are limited, due to the low budget, the prison crisis, the increase in crime and the lack of attention to this problem, determining that regulatory compliance is not effective, due to the objective it generates of the present investigation.
