Abstract
El presente artículo científico contiene un análisis jurídico, en cuanto a la viabilidad que tiene la teoría el error de prohibición en el Ecuador, misma que ha sido propuesta en varias ocasiones por parte de expertos en el tema, los cuales indicaban la necesidad de aplicarla; sin embargo, fue aprobada en la ley reformatoria al COIP en el año 2019, para que en junio del año 2020 entrara en vigencia, necesidad que se ve fundamentada en varios textos doctrinarios, que estudian los aspectos formales de dicha figura, así como también, la importancia que tiene al momento de determinar la culpabilidad de las personas por la comisión de un injusto penal. Además, la evitabilidad que pudiese existir de cometer un delito, misma que se ve reflejada a través de la aplicación del error vencible e invencible, los cuales determinan los casos en donde podría presentarse un error de prohibición, así como la forma de condenar o eximir la culpabilidad. Se puede evidenciar varias normas que forman parte del derecho comparado de la región, mismos que tipifican al error de prohibición desde hace varios años. Por último, encontramos una fuerte discusión en cuanto al error de prohibición culturalmente condicionado, el mismo que se encuentra varias veces tergiversado en su esencia, pero que finalmente busca equidad al momento de aplicar la Justicia. El trabajo se encuentra elaborado puramente de la revisión documental de varios textos y normas que estudian al error de prohibición, por lo cual no contiene criterios ni opiniones personales de terceros que pudieren desviar la investigación. Es así que el error de prohibición y el error de prohibición culturalmente condicionado constituyen herramientas muy necesarias en todo ordenamiento jurídico.

It can be evidenced several norms that are part of the comparative law of the region, which typify the error of prohibition for several years; Finally, we find a strong discussion regarding the culturally conditioned prohibition error, which is found several times distorted in its essence, but which finally seeks equity when applying Justice. The work is elaborated purely from the documentary review of several texts and norms that study the prohibition error, for which it does not contain criteria or personal opinions of third parties that could divert the investigation. Thus, the error of prohibition and the error of culturally conditioned prohibition are very necessary tools in any legal system.
