Abstract
El presente artículo científico establece un análisis jurídico del alcance de la
competencia de jueces penales frente a la defensa del consumidor, ya que en nuestro
ordenamiento jurídico la Ley de Defensa del Consumidor no establece los
procedimientos claros a seguir y en cuanto a la competencia de los jueces representa
también un problema ya que la materia de defensa del consumidor es de suma
importancia pero pasa desapercibida, en nuestra sociedad por el simple hecho de que
constantemente adquirimos productos o contratamos un servicio en específico pueden
existir problemas entre los proveedores con los consumidores, por lo que se convierte
en una materia civil ya que existe una relación contractual o de servicios entre
particulares, por lo tanto los jueces competentes en estos casos deberían ser los
civiles.
This scientific article establishes a legal analysis of the scope of the jurisdiction of criminal judges against the defense of the consumer, since in our legal order the Consumer Protection Act does not establish the clear procedures to follow and as regards the jurisdiction of judges is also a problem since the matter of consumer protection is of the utmost importance but goes unnoticed , in our society simply because we constantly purchase products or contract a specific service there may be problems between suppliers with consumers, so it becomes a civil matter since there is a contractual or service relationship between individuals, therefore the competent judges in these cases should be civil ones.
