Abstract
El título de este trabajo es “Análisis jurídico sobre la operatividad de drones y su afectación al derecho a la intimidad en el Ecuador, el cual centra su interés en la situación jurídica derivada del uso de dichas aeronaves pilotadas a distancia y su impacto en el derecho de la persona a su intimidad\; es decir, se enfoca en las posibles violaciones a la esfera íntima y privada de los ciudadanos. De allí que podríamos formular la siguiente pregunta: ¿Podría la operatividad de drones en el Ecuador violar el derecho a la intimidad personal y familiar? En este sentido, el objetivo de esta investigación es determinar la eficacia de la normativa nacional vigente del derecho a la intimidad, frente al uso y operación de las referidas aeronaves. Este tema, aunque ha sido poco estudiado en el país, tiene relevancia y trascendencia en el ámbito de las nuevas relaciones de la sociedad con los avances tecnológicos, lo cual evidencia la importancia de la presente investigación. El método utilizado es el normativista, apoyado en el derecho comparado y el método deductivo. Esta investigación documental exploratoria determinó que, sin duda alguna, existe el riego de violación de la intimidad y privacidad, en razón del déficit normativo regulador del uso y operación de los drones\; lo que implicaría una violación de los derechos protegidos en los Tratados Internacionales, la Constitución y demás legislación nacional vigente.
The title of this work is 'Legal analysis on the operation of drones and its impact on the right to privacy in Ecuador, which focuses on the legal situation derived from the use of said remotely piloted aircraft and its impact on the law from the person to their privacy\; that is, it focuses on possible violations to the intimate and private sphere of citizens. Hence, we could ask the following question: Could the operation of drones in Ecuador violate the right to personal and family privacy? In this sense, the objective of this investigation is to determine the effectiveness of the current national regulations on the right to privacy, against the use and operation of the aforementioned aircraft. This topic, although it has been little studied in the country, has relevance and significance in the field of the new relationships of society with technological advances, which shows the importance of this research. The method used is the normative one, supported by comparative law and the deductive method. This exploratory documentary investigation determined that, without any doubt, there is a risk of violation of privacy and privacy, due to the regulatory deficit regarding the use and operation of drones\; which would imply a violation of the rights protected in the International Treaties, the Constitution and other current national legislation.
