Item Open Access Análisis administrativo y judicial del acuerdo ministerial MINEDUC-2017-00052-A instructivo de actuación, en los establecimientos del sistema educativo nacional y los procesos para la investigación y sanción, en la ciudad de Ibarra, en el periodo 2017-2018(Pontificia Universidad Católica del Ecuador Sede Ibarra, 2019-02) Iza Ayala, Ronny EmanuelThe present study of Degree, "Administrative and judicial analysis of the Ministerial Agreement MINEDUC-2017-00052-A Instructions for action, in the establishments of the national educational system and the processes for investigation and sanction, in the city of Ibarra, in the period 2017-2018 ”, proposes a legal-social position, based on the analysis of administrative and judicial processes, when a Sexual Abuse has been committed in an educational institution by the teacher towards the student body; Thus, it reflects the issue of the protection of the rights of girls, boys and adolescents within the educational and institutional framework, in reference to the Zero Tolerance Program, given the notable increase in sexual abuse in the different public educational institutions of the city of Ibarra, Imbabura province, during the period 2017-2018. The central idea was to carry out a descriptive and evaluative analysis of the Ministerial Agreement MINEDUC-2017-00052-A, within the Ecuadorian regulatory framework, that is, to specify a logical perspective of the sanction process towards teachers who have committed sexual abuse. The analysis and discussion of the results - theoretical and practical - obtained reveal the increase in so-called sexual crimes within the educational establishments of the city of Ibarra, thus connoting the administrative and judicial sanction against offenders, taking into account the direct application of the aforementioned Ministerial Agreement in order to justify the administrative and judicial process against the commission of a sexual crime, which must not go unpunished.
