This paper aims to evaluate the judicial referral to mediation as a mechanism for improving justice, just as this issue has a very significant relevance, since its purpose is to provide citizens with the possibility of access to justice, Taking into account that the state is that institution that has the power and the obligation to administer it, such justice is not only resolved through a judicial procedure as socially is believed, there are also different alternatives such as mediation, where problems are solved by taking Account regulatory parameters. For the reasons given above, the improvement of access to justice is palpable as a need not only of Ecuador but of the entire world, a need that can be satisfied by the implementation of public policies in favor of the use of alternative methods of conflict resolution, thus enabling the decongestion of processes that are processed in the Council of the Judiciary, understood as the entity that assumes the administration of ordinary justice in Ecuador.Item Open Access La mediación como herramienta de la justicia restaurativa en casos de adolescentes infractores(Pontificia Universidad Católica del Ecuador, 2019) Ramírez Coque, Gabriela Elizabeth; Lescano Galeas, Viviana NathaliaEn las últimas décadas, una de las principales discusiones del derecho penal en materia de adolescentes infractores versa en torno a la vaga respuesta gubernamental que se ha tenido en la resolución de conflictos, allí la necesidad de implementar la mediación con enfoque restaurativo, constituyéndose en un mecanismo alternativo de resolución de conflictos que a más de optimizar y dinamizar la administración de justicia, procura generar espacios óptimos para la rehabilitación y la reinserción social, a partir del resarcimiento del daño y la consecución de la paz. La investigación tiene como objetivo analizar la mediación como herramienta de la justicia restaurativa en casos de adolescentes infractores. El problema expuesto refleja que no existe una óptima resolución de conflictos penales en materia juvenil, ya que se aplica la mediación con enfoque retributivo y más no restaurativo. Mediante la aplicación del método analítico sintético y entrevistas realizadas a mediadores con experticia en adolescentes infractores, fiscales especializados y un delegado con experiencia en justicia restaurativa, se analizaron los diversos preceptos doctrinarios y jurídicos que sirven de fundamento para la implementación de la mediación restaurativa en casos de adolescentes infractores, considerando las experiencias obtenidas en países donde ésta ya se aplica, para consecuentemente determinar los casos en que se podría emplear. Entre los resultados relevantes se muestra que en el sistema penal ecuatoriano la mediación restaurativa se emplea de forma complementaria y limitada, mas no de forma obligatoria a causa de que existen operadores de justicia que se rehúsan a su implementación.
