Item Open Access El Hábeas Corpus y el derecho a la protección de la integridad física de las personas privadas de la libertad en la cárcel de Ibarra, periodo 2021-2022(Pontificia Universidad Católica del Ecuador Ibarra, 2023-02) Andrade Herrera, Anggie NicoleThe research entitled "Hábeas Corpus and the right to the protection of the physical integrity of persons deprived of liberty in the prison of Ibarra, period 2021-2022", which addressed the habeas corpus actions filed by persons deprived of liberty (PPL) in the canton of Ibarra who claimed to have been victims of violations of the right to physical integrity in the Center of Deprivation of Liberty in the city of Ibarra. Regarding this situation, the state of the art has been analyzed in the relevant regulations, doctrine and jurisprudence, taking into account that the PPL constantly face situations that threaten their rights. The importance of the research lies in the fact that it will determine the situation of the PPL in the Center of Deprivation of Liberty. The general objective of the research work was to analyze the effectiveness of the habeas corpus action for the protection of the right to physical integrity of the PPL in the Ibarra prison, through an analysis of real cases presented in the period 2021-2022 in the Ibarra canton, in order to make recommendations to help prevent future violations of the right to physical integrity. For this purpose, from a qualitative approach, the socio-legal and synthetic analytical methods were applied, through the use of documentary review and analysis techniques, case summary sheets and interviews. Among the conclusions obtained is that habeas corpus is a suitable mechanism to protect the right to liberty and related rights. In the case of ppl, it also protects their right to integrity. From the casuistic analysis it is concluded that this jurisdictional guarantee is not effective for the fulfillment of its purpose with respect to the protection of the right to physical integrity, since the main purpose of the corrective habeas corpus is not fulfilled since the measures of integral reparation are not fulfilled in their totality.
