Abstract
La presente investigación tiene como objeto examinar la situación laboral de las personas con discapacidad en relación con las garantías laborales que tienen estas personas. Para el alcance de esta investigación se realizó un análisis comparativo al Código de Trabajo y la Ley Orgánica de Servicio Público sobre las garantías de inserción y estabilidad laboral para las personas con discapacidad con el propósito de identificar si se cumple o no con estas garantías en el cantón Antonio Ante. El método científico utilizado en la presente investigación es de enfoque cuantitativa debido a que se analizó las disposiciones legales del Código de Trabajo y la Ley Orgánica de Servicio Público en relación a la inclusión de personas con discapacidad al ámbito laboral. Así también, se utilizó un enfoque cualitativo permitiendo identificar mediante un análisis exhaustivo si se cumple o no con lo dispuesto en la Ley Orgánica de Discapacidades la política de inclusión laboral y verificar si la Ley Orgánica de Servicio Público y el Código de Trabajo contemplan normas que garantizan que las personas con algún tipo de discapacidad puedan acceder a un trabajo digno de acuerdo a sus capacidades y necesidades. Sin embargo, en el transcurso de la investigación se evidencia que en la práctica aún existen vacíos en el cumplimiento efectivo de estas garantías por parte de los empleadores tanto del sector público como del privado.
The purpose of this research is to examine the employment situation of people with disabilities in relation to the employment guarantees that these people have. For the scope of this research, a comparative analysis was carried out to the Labor Code and the Organic Law of Public Service on the guarantees of insertion and job stability for people with disabilities with the purpose of identifying whether or not these guarantees are complied with in the canton Antonio Ante. The scientific method used in this research is quantitative in approach because the legal provisions of the Labor Code and the Organic Law of Public Service were analyzed in relation to the inclusion of people with disabilities in the workplace. Likewise, a qualitative approach was used to identify, through an exhaustive analysis, whether or not the provisions of the Organic Law on Disabilities comply with the labor inclusion policy and verify whether the Organic Law of Public Service and the Labor Code contemplate norms that They guarantee that people with some type of disability can access decent work according to their abilities and needs. However, in the course of the investigation it is evident that in practice there are still gaps in the effective compliance of these guarantees by employers in both the public and private sectors.
