Efectividad de las medidas administrativas de protección a favor de los adultos mayores en la ciudad de Ibarra en el periodo 2022-2023

Abstract

El objetivo general de esta investigación fue evaluar la efectividad de las medidas administrativas de protección a favor de los adultos mayores en la ciudad de Ibarra en el periodo 2022-2023, a través del estudio y seguimiento de los casos conocidos por el Consejo Cantonal de Protección de Derechos, con el fin de determinar si las mismas están cumpliendo el objetivo para el cual han sido creadas. La investigación se realizó desde un enfoque mixto, abarcando parámetros cualitativos y cuantitativos, con un alcance descriptivo, en lo que respecta a la aplicación de medidas administrativas a un determinado grupo de la sociedad. Los métodos utilizados fueron el socio-jurídico, por estar centrado el estudio en un grupo de atención prioritaria como lo son las personas adultas mayores; y el normativista que permitió analizar las normas constitucionales, legales y reglamentarias que reconocen los derechos de estas personas y establecen las medidas administrativas de protección. De la información obtenida a través de las técnicas e instrumentos utilizados pudo evidenciarse que existe un déficit de investigaciones en esta materia, lo que imprime relevancia y pertinencia a este trabajo. Se concluyó que la información analizada en los expedientes se contrapone de manera parcial con lo establecido en el Reglamento General a la Ley Orgánica de las Personas Adultas Mayores, en relación a las competencias atribuidas a la Junta Cantonal de Protección de Derechos Especializada de Ibarra, existiendo falencias en cuanto al desarrollo y seguimiento de los casos en los que se han dictado estas medidas, en detrimento de los derechos de las personas adultas mayores. De manera que no puede considerarse concluida la investigación en este campo, existiendo la necesidad de realizar nuevas investigaciones en periodos posteriores al 2022-2023. The general objective of this research was to evaluate the effectiveness of administrative protection measures in favor of older adults in the city of Ibarra in the period 2022-2023, through the study and monitoring of cases known by the Cantonal Council for the Protection of Rights, in order to determine whether they are fulfilling the objective for which they were created. The research was carried out from a mixed approach, covering qualitative and quantitative parameters, with a descriptive scope, regarding the application of administrative measures to a certain group of society. The methods used were socio-legal, since the study was focused on a group of priority attention such as the elderly; and normative, which made it possible to analyze the constitutional, legal and regulatory norms that recognize the rights of these people and establish administrative protection measures. From the information obtained through the techniques and instruments used, it became evident that there is a lack of research on this subject, which makes this work relevant and pertinent. It was concluded that the information analyzed in the files is partially in conflict with the provisions of the General Regulations to the Organic Law of Older Adults, in relation to the powers attributed to the Cantonal Board of Protection of Specialized Rights of Ibarra, there are shortcomings in the development and monitoring of cases in which these measures have been issued, to the detriment of the rights of older adults. Therefore, the investigation in this field cannot be considered concluded, and there is a need to carry out new investigations in periods subsequent to 2022-2023.
