Abstract
En la presente investigación se realizó un análisis de la eficacia jurídica de la garantía
constitucional de Habeas Corpus en la ciudad de Ibarra, durante el año 2017, por medio de la
investigación documental de textos tanto físicos como virtuales existentes acerca del tema, de
los cuales se extrajo la información principal que consta en el desarrollo del estado del arte,
seguidamente se realizó un análisis de los datos estadísticos aportados por la Dirección
Provincial del Consejo de la Judicatura de Imbabura acerca de la totalidad de acciones de Habeas
Corpus presentadas durante el año 2017, de las cuales se obtuvo los respectivos porcentajes
tanto de aquellas acciones que fueron otorgadas por parte de los juzgadores como de aquellas
que fueron negadas por los mismos, de esta totalidad de causas se procedió a seleccionar un
proceso el cual fue debidamente analizado tomando en cuenta los aspectos que influyen en la
eficacia de esta garantía jurisdiccional, finalmente se realizaron tres entrevistas a distintos
expertos en el tema quienes a base de su experiencia aportaron con información fundamental
para solventar los objetivos de la presente investigación, una vez obtenida toda esta información
se realizó un análisis correlacional de la misma para establecer como principal resultado el hecho
de que la garantía constitucional de Habeas Corpus efectivamente goza de eficacia jurídica
siempre y cuando sea debidamente presentada y por lo tanto cumpla con los requisitos tanto
materiales como formales establecidos por la Constitución de la República del Ecuador y la Ley
Orgánica de Garantías Jurisdiccionales y Control Constitucional.
In the present investigation, an analysis of the legal effectiveness of the constitutional guarantee of Habeas Corpus in the city of Ibarra was carried out during 2017, through the documentary investigation of both physical and virtual texts existing on the subject, of which The main information contained in the development of the state of the art was extracted, then an analysis of the statistical data provided by the Provincial Directorate of the Judicial Council of Imbabura about all the actions of Habeas Corpus presented during 2017 was carried out , of which the respective percentages were obtained both for those actions that were granted by the judges and for those that were denied by them, from this total number of cases, a process was selected which was duly analyzed taking into account the aspects that influence the effectiveness of this jurisdictional guarantee, finally Three interviews were conducted with different experts on the subject who, based on their experience, provided with fundamental information to solve the objectives of the present investigation, once all this information was obtained, a correlational analysis was carried out to establish the fact as the main result. that the constitutional guarantee of Habeas Corpus effectively enjoys legal efficacy as long as it is duly presented and therefore complies with both the material and formal requirements established by the Constitution of the Republic of Ecuador and the Organic Law of Jurisdictional Guarantees and Constitutional Control.
