Eficiencia y aplicación del principio de oportunidad en materia penal en la ciudad de Ibarra en el año 2022

Abstract

El principio de oportunidad es una facultad del agente fiscal, consagrada dentro de la Constitución y el Código Orgánico Integral Penal, debido a su ambigüedad en la norma, no se explica que fin y beneficio contempla su aplicación, el cual fue creado con el propósito de descongestionar el sistema procesal penal, siendo así un mecanismo extrapenal, el cual concuerda con lo planteado en el principio de mínima intervención penal; por lo que se inició el correspondiente estudio que tuvo como objetivo general determinar la eficiencia del principio de oportunidad en el sistema procesal penal de la ciudad de Ibarra, revisando la normativa, datos, estadísticas y trámites judiciales del año 2022, comprobando o no una correcta aplicación procesal, utilizando una metodología con un enfoque mixto, cualitativo por el análisis de la documentación pertinente y cuantitativo estableciendo la descongestión procesal ocasionada, un nivel de profundidad descriptivo debido a que el tema ha sido previamente tratado, pero no de la manera presente en este trabajo, como método de investigación se aplicó el método normativista analizando la norma, enfoque y aplicación, las técnicas empleadas en el presente trabajo fueron la revisión documental de jurisprudencia, trámites judiciales y la entrevista a profesionales del derecho con el fin de poder recopilar información que ayuden a lograr los objetivos, los instrumentos empleados fueron la ficha digital en el que se describe la tramitaciones judiciales y la jurisprudencia existente, y el cuestionario que fue realizado a profesionales con amplia experiencia en la materia, donde se obtuvo diversos criterios de la aplicación del principio de oportunidad, los resultados más importantes fueron, establecer que el principio de oportunidad no es eficiente en la ciudad de Ibarra, y concluir que no induce a la impunidad, tomando en cuenta que su aplicación produce otros problemas jurídicos. The principle of opportunity is a power of the fiscal agent, enshrined within the Constitution and the Comprehensive Criminal Organic Code due to its ambiguity in the norm, it is not explained what purpose and benefit its application contemplates, which was created with the objective of decongesting the criminal procedural system, thus being an extra-penal mechanism, which agrees with what is stated in the principle of minimal criminal intervention; Therefore, the corresponding study was initiated with the general objective of determining the efficiency of the principle of opportunity in the criminal procedural system of the city of Ibarra, reviewing the regulations, data, statistics and judicial procedures for the year 2022, verifying or not a correct procedural application, using a methodology with a mixed approach, qualitative by analyzing the relevant documentation and quantitative by establishing the procedural decongestion caused, a level of descriptive depth because the topic has been previously treated, but not in the way presented in this work, as a research method the normativity method was applied, analyzing the norm, approach and application, the techniques used in the present work were the documentary review of jurisprudence, judicial procedures and the interview with legal professionals in order to be able to collect information that helps achieve the objectives, the instruments used were the digital file in which the judicial procedures are described and the existing jurisprudence, and the questionnaire that was carried out to professionals with extensive experience in the matter, where various criteria was obtained from the application of the principle of opportunity, the most important results were, establishing that the principle of opportunity is not efficient in the city of Ibarra, and conclude that it does not lead to impunity, taking into account that its application produces other legal problems.
