Abstract
El presente trabajo de investigación sobre la eficacia de las medidas de protección, emitidas
a favor de las mujeres víctimas de violencia intrafamiliar en el cantón Cotacachi: periodo
2020-202, tiene por objetivo general determinar si las medidas judiciales de protección
emitidas a favor de las mujeres víctimas de violencia intrafamiliar han cumplido la finalidad
de precautelar la integridad de la mujer para la cual fueron emitidas, mediante el seguimiento
y análisis de casos reales seleccionados en el periodo 2020-2021, lo que permitirá evaluar
su eficacia, y los objetivos específicos buscan describir la violencia intrafamiliar como
fenómeno jurídico, establecer la acción de protección como garantía Constitución y en el
ámbito jurisdiccional e identificar si las mujeres víctimas de violencia presentaron acciones
de protección y si se cumplieron las mismas. Para ello se realizó un revisión y análisis
documental de estudios, documentos y artículos científicos a nivel internacional y nacional
que fundamentan el tema de estudio. La metodología utilizada fue de enfoque cualitativo,
los métodos que facilitaron en trabajo fueron en socio-jurídico, inductivo y deductivo, las
técnicas la entrevista y la revisión documental, y como instrumento de recolección de datos
fue el cuestionario.
Dentro de las conclusiones se establece la violencia intrafamiliar como fenómeno jurídico
que cuenta normativa que garantiza los derechos de las mujeres víctimas de vulneración de
derechos, basada en políticas internacionales de la ONU, UNESMUN, OMS, diversas
Convenciones que buscan prevenir y erradicar las agresiones contra la mujer. Ecuador cuenta
con una normativa Constitucional y Leyes conexas como COIP, LOIPEVM y otras que
garantizar el derecho de la mujer ante este tipo de violencia, pero la falta dar seguimiento a
estos casos para verificar el cumplimiento de las medidas de protección emitidas, así mismo
en muchos casos no se cumplen las medidas porque las víctimas retiran las denuncias.
The present research work on the effectiveness of protection measures, issued in favor of women victims of intrafamily violence in the Cotacachi canton: period 2020-202, has the general objective of determining whether the judicial protection measures issued in favor of women victims of intrafamily violence have fulfilled the purpose of protecting the integrity of the woman for whom they were issued, by monitoring and analyzing real cases selected in the period 2020-2021, which will allow evaluating their effectiveness, and the specific objectives seek describe intrafamily violence as a legal phenomenon, establish the protection action as a guarantee of the Constitution and in the jurisdictional sphere and identify if the women victims of violence presented protection actions and if they were complied with. For this, a review and documentary analysis of studies, documents and scientific articles at the international and national level that support the subject of study was carried out. The methodology used was a qualitative approach, the methods that facilitated the work were socio-legal, inductive and deductive, the interview and documentary review techniques, and the questionnaire as a data collection instrument. Within the conclusions, intrafamily violence is established as a legal phenomenon that has regulations that guarantee the rights of women victims of rights violations, based on international policies of the UN, UNESMUN, WHO, various Conventions that seek to prevent and eradicate aggressions against the woman. Ecuador has Constitutional regulations and related laws such as COIP, LOIPEVM and others that guarantee the right of women in the face of this type of violence, but the lack of follow-up on these cases to verify compliance with the protection measures issued, likewise in In many cases, the measures are not complied with because the victims withdraw their complaints.
