Abstract
El tema trata sobre la influencia mediática en los procesos judiciales: caso David Velasteguí y Andrés Padilla. Para ello se planteó un objetivo general de Realizar un estudio del caso de David Velasteguí y Andrés Padilla mediante el análisis cualitativo de la información primaria y secundaria para la determinación de la influencia mediática durante el desarrollo de las resoluciones judiciales. La investigación partió del método cualitativo, apoyado del soiocio jurídico y bibliográfico documental para analizar el caso motivo de estudio. Se procedió a analizar el caso número 10281-2018-01513 del Cabo de Policía procesado, por extralimitación de la fuerza y causó la muerte de la víctima, se siguió un juicio ordinario. El victimario se acogió al derecho a la defensa, donde facilitaron las pruebas pertinentes logrando obtener una pena reducida de 3 años y 4 meses, puesto que los jueces asumieron que la muerte ocasionada fue en legítima defensa. La influencia mediática se evidencia al momento en que los jueces concluyeron que el uso del arma de dotación y su detonación fue en legítima defensa.
The topic deals with the media influence in the judicial processes: the David Velasteguí and Andrés Padilla case, for which a general objective was proposed to determine the media influence during the development of the judicial decisions of the David Velasteguí and Andrés Padilla case. The perpetrator availed himself of the right to defense, where the pertinent evidence was provided, obtaining a reduced sentence of 3 years and 4 months, since the judges assumed that the death caused was in legitimate defense. The media influence is given in part because the judges concluded that the case was given for legitimate defense, it also requires requirements in which there is the rational need for the defense, which means that the state of necessity must justify what has not been proven. by the police corporal.
