Abstract
El Estado Ecuatoriano reconoce derechos específicos a los niños, niñas y adolescentes al ser considerados un grupo de atención prioritaria, sin embargo son víctimas de maltrato constantemente, por tal razón, el objetivo del presente trabajo es diagnosticar el acogimiento institucional como una medida de protección en los casos resueltos por maltrato a niños, niñas y adolescentes\; en dicho análisis se llegará a demostrar la necesidad de aplicar alternativas a la institucionalización atendiendo el principio del interés superior. Para proponer dichas alternativas, en el proyecto se realiza entrevistas tanto a los Jueces de la Unidad de Familia, Mujer, Niñez y Adolescencia, miembros de la Junta Cantonal de Protección de Derechos de Niños, Niñas y Adolescentes como a los directores, equipo técnico y niños, niñas, adolescentes de las diversas instituciones de acogida, lo que permite tratar directamente el problema de investigación y deducir de esta manera la medida de protección idónea al presentarse este tipo de situación, así como la corresponsabilidad entre el Estado- Sociedad y Familia.
The state of Ecuador recognizes the rights of children and adolescents, yet they are constantly victims of abuse even though they are in the group of priority attention. For this reason, the aim of this dissertation is to diagnose institutional foster care as a protective measure in the resolved cases of child and adolescent abuse. This analysis will demonstrate the need to apply alternatives to the institutionalization of foster care in this case, taking into account the principle of best interests.To propose these alternatives, interviews with the judges from the Family, Women, Children and Adolescents Unit, members of the Cantonal Children and Youth Rights Protection Board as well as with the directors, technical team and the boys, girls and teens from the various foster care institutions are carried out in the project. This will help to treat the research problem directly and in this way deduce the appropriate protective measure to be applied in this type of situation as well as the responsibility shared between the state-society and family.
