This study is immersed in effective cooperation, recognized within the Premium Criminal Law as a technique used by the States in a criminal tax investigation and relating it to the Plea Bargaining System originating from the North American criminal system. In this legal figure the defendant intervenes, there is the necessary information to be the beneficiary of a reasonable reduction in the deprivation of liberty that corresponds to the criminal act committed. On the other hand, this can cause legal effects that violate the rights of the accused, the right to non-self-incrimination and the right to remain silent being the most threatened. In addition, it can be noted that it is the power of the Prosecutor's Office to process and request the execution of effective cooperation and, if necessary, also request the application of preventive detention as an essential measure, of last ratio, so that the accused can appear before the competent judge; It will be in charge of considering whether or not the execution of these legal figures is viable. That is why the purpose of the study focuses on the analysis of doctrine and legislation related to the legal effects that produce effective cooperation, thus denoting that the importance of this tool, in the criminal procedural field, is to ensure the success of tax inquiry when obtaining information through other means is difficult. It is worth mentioning that in all criminal cases the rights of the accused and the victim must be prioritized and guaranteed in order to maintain the integrity of the process.
