Abstract
El presente estudio se ha efectuado con el objeto de analizar la vulneración del derecho a la salud en personas con enfermedades catastróficas y el estudio de la acción de protección para garantizar este derecho en la ciudad de Ibarra en el año 2020, mediante la revisión de las normas vigentes respecto al derecho a la salud de las personas con enfermedades catastróficas contemplado en Ecuador, así como la identificación de los casos en los que se ha interpuesto la garantía de acción de protección para proteger su derecho como grupo vulnerable para así determinar el cumplimiento de los postulados constitucionales sobre el derecho a la salud de las personas con enfermedades catastróficas como un deber del Estado y la acción de protección como garantía efectiva de protección de este derecho. La metodología aplicada se encuentra desde enfoque de investigación cualitativo realizado conforme a los métodos socio jurídico, normativista y analítico. A la luz de los objetivos se concluye: que la acción de protección como mecanismo para garantizar el derecho a la salud solo a nivel formal es eficaz ya que la norma prevé este instrumento con ese fin, sin embargo en casos prácticos no se verifica esta eficacia al 100% debido a que como se analizó en el presente trabajo muchas veces se sacrifica el efectivo goce del derecho a la salud, por la mera omisión de formalidades; además se identificó que existe una ineficaz aplicación del derecho por parte del Estado Ecuatoriano a los pacientes con enfermedades catastróficas los mismos que constituyen un grupo de atención prioritaria, generándose vulneraciones a este derecho humano vinculadas a factores como insuficiente presupuesto, y por ende falta de insumos, medicamentos lo que impide a estos seres humanos lograr una vida digna.
The present study has been carried out in order to analyze the violation of the right to health in people with catastrophic illnesses and the study of the protection action to guarantee this right in the city of Ibarra in the year 2020, by reviewing the current regulations regarding the right to health of people with catastrophic illnesses contemplated in Ecuador, as well as the identification of cases in which the guarantee of protection action has been filed to protect their right as a vulnerable group in order to determine compliance with the constitutional postulates on the right to health of people with catastrophic illnesses as a duty of the State and the action of protection as an effective guarantee of protection of this right. The applied methodology is found from a qualitative research approach carried out in accordance with the socio-legal, normative and analytical methods, which allowed establishing that the protection action is a jurisdictional guarantee that is responsible for protecting the fundamental rights of people, with greater emphasis when it comes to people who belong to a constitutionally recognized vulnerable group. In conclusion, it has been determined that the protection action is effective as a constitutional guarantee, which allows to act in a timely manner in the face of the violation of the right to health, finally, once the review and analysis of the information available on This study has established that there are no necessary arguments to presume the violation of the right to health.
