Abstract
El presente trabajo de investigación aborda un problema de actualidad relacionado con la actividad minera en el cantón Cotacachi, zona de Íntag, para analizar su nivel de impacto en relación con los derechos de la naturaleza y el de las personas a vivir en un entorno sano y ecológicamente equilibrado, garantizados en la Constitución vigente. El estudio se fundamentó en el análisis de investigaciones previas, la normativa pertinente y jurisprudencia de la Corte Provincial de Imbabura. El objetivo general fue evaluar el impacto de la actividad minera en la zona de Intag, del cantón Cotacachi durante el período 2021-2022, sobre los derechos de la naturaleza y el derecho de las personas a un ambiente sano, mediante el estudio y seguimiento del Proyecto Llurimagua, con el fin de conocer las implicaciones ambientales y sociales de dicha actividad. La importancia del estudio radica en el análisis de un problema de actualidad que tiene consecuencias ambientales y sociales para la población y genera conocimiento en el campo jurídico. La investigación tuvo un enfoque cualitativo, un estudio documental cuyo nivel de profundidad fue descriptivo. Las técnicas de la investigación utilizadas fueron análisis documental y la entrevista. Se recurrió a los métodos: analítico, inductivo deductivo y socio jurídico. Los resultados evidencian que se produjo impacto negativo generado por la actividad minera del proyecto Llurimagua sobre los derechos de la naturaleza y el de las personas a un ambiente sano y ecológicamente equilibrado; no se cumplió con la consulta ambiental, existieron graves falencias en el estudio de impacto y el plan de manejo ambiental. No se adoptaron las medidas adecuadas para proteger la naturaleza, las especies de flora y fauna del ecosistema; consecuencias sociales por no haber cumplido los lineamientos y requisitos previstos para la consulta ambiental.
This research work addresses a current problem related to the mining activity in the Cotacachi canton, Intag area, to analyze the level of impact of mining activity in relation to the rights of nature and the right of people to live in a healthy and ecologically balanced environment, as guaranteed in the current Constitution. The study was based on the analysis of previous research, relevant regulations, and jurisprudence of the Provincial Court of Imbabura. The general objective was to evaluate the impact of mining activity in the Intag area of the Cotacachi canton during the period 2021-2022, on the rights of nature and the right of people to a healthy environment, through the study and monitoring of the Llurimagua Project, to understand the environmental and social implications of this activity. The importance of the study lies in the analysis of a current problem that has environmental and social consequences for the population and generates knowledge in the legal field. The research had a qualitative approach, a documentary study whose level of depth was descriptive. The research technique used was the interview. The following methods were used: analytical, inductive-deductive, and socio-legal. The results show that there was a negative impact generated by the mining activity of the Llurimagua project on the rights of nature and the rights of people to a healthy and ecologically balanced environment; the environmental consultation was not complied with, there were serious flaws in the impact study and the environmental management plan, adequate measures were not adopted to protect nature, flora and fauna species of the ecosystem; social consequences for not having complied with the guidelines and requirements foreseen for the environmental consultation.
