Abstract
La acción de protección en el Estado Ecuatoriano tiene como finalidad el precautelar los derechos constitucionales ante violaciones realizadas por personas naturales o jurídicas, mismas que tienen la facultad de acudir ante el organismo judicial competente, para exigir la prevención, o la cesación y reparación del derecho vulnerado. De esta manera, la problemática se ha convertido en analizar, de forma descriptiva, la admisibilidad y procedencia de la acción de protección, los elementos y requisitos de las mismas, en sí, se trata de un análisis de forma al procedimiento de la acción de protección, procedimiento que se ha visto envuelto en varias interpretaciones por los diversos actores del proceso constitucional; sin embargo, el máximo organismo de interpretación de la Carta Magna, la Corte Constitucional, ha referido cuales son las causales de inadmisión específicamente, las cuales, podrían terminar con el archivo de la acción desde el inicio de la misma, mientras que sucede todo lo opuesto con el tema de la procedencia, la cual deberá ser sustentada en la audiencia y el juzgador podrá resolver motivadamente en su sentencia, la existencia o no de una o más causales de improcedencia.
The protection action in the Ecuadorian State is intended to protect constitutional rights against violations carried out by natural or legal persons, who have the power to go before the competent judicial body, to demand the prevention, or the cessation and reparation of the right violated. In this way, the problem has turned into analyzing, in a descriptive way, the admissibility and origin of the protection action, the elements and requirements of the same. It is a formal analysis of the procedure of the action of protection, a procedure that has been involved in various interpretations by the various actors in the constitutional process. However, the highest body for the interpretation of the Magna Carta, the Constitutional Court, has specifically referred to the grounds for inadmissibility, which could end with the filing of the action from the beginning of the same, while everything happens. Opposed to the issue of provenance, which must be supported at the hearing and the judge may reasonably resolve in his sentence, the existence or not of one or more grounds of inadmissibility.
