| dc.description.abstract | La presente investigación se titula Análisis de la Consulta Previa, Libre e Informada en los Acuerdos y Jurisprudencia Internacional: Análisis del Caso Sarayaku Vs Ecuador , misma que se centra en analizar la sentencia del Caso Pueblo Indígena Kichwa de Sarayaku vs Ecuador, y la vulneración del derecho a la consulta previa, libre e informada, en relación con el derecho a la propiedad comunal, al derecho a un ambiente sano y equilibrado, el derecho a la identidad cultural, la seguridad jurídica; y todos los derechos del Buen Vivir. Además, existe un aporte significativo en este precedente jurisprudencial de la CIDH y es que se analiza el derecho a la identidad cultural de forma integral, conectándolo con el derecho a la propiedad comunal y a la consulta previa, libre e informada, en tanto que estos territorios no solo son espacios necesarios para la subsistencia de las comunidades, sino que representan sitios sagrados pilares de ritos religiosos indispensables para la fe del Pueblo Indígena Sarayaku. Por ello, el objetivo general de este proyecto fue: analizar el derecho a la Consulta Previa, Libre e Informada en el Caso Sarayaku Vs Ecuador, tomando en cuenta los Acuerdos y Jurisprudencia Internacional (2003- 2012). Los métodos aplicados fueron el lógico deductivo, que permitió analizar la sentencia desde la consideración general de que se habían alegado vulneraciones a derechos en la petición enviada a la CIDH, hasta los hechos y pruebas individualizadas que fundamentaron la responsabilidad del Estado; y, el método lógico inductivo, en tanto que permitía partir de preguntas generales a profesionales del derecho, para obtener respuestas específicas respecto a la difusión de conocimientos que se habían alcanzado gracias al precedente jurisprudencial analizado. Los resultados y las conclusiones podrán ser apreciados por el lector a lo largo del presente proyecto. | |
| dc.description.abstract | The former investigation is titled The Previous, Free and Informed Consultation under the Light of the Agreements and International Jurisprudence: Analysis of the Sarayaku Case Vs Ecuador , which focuses on analyzing the judgment of the Case of the Kichwa Indigenous People of Sarayaku vs. Ecuador, and the violation of the right to previous, free and informed consultation, and the relationship of it with the right to communal property, the right to a healthy and balanced environment, the right to cultural identity, legal security; and all the rights of Good Living. In addition, there is a significant contribution in this jurisprudential precedent of the CIDH and that is that the right to cultural identity is analyzed in a comprehensive manner, connecting it with the right to communal property and to prior, free and informed consultation, as these territories They are not only necessary spaces for the subsistence of the communities, but they represent sacred sites, pillars of religious rites, indispensable for the faith of the Sarayaku Indigenous People. Therefore, the general objective of this project was: to analyze the right to Free, Prior and Informed Consultation in the Sarayaku Vs Ecuador Case, taking into account the Agreements and International Jurisprudence (2003-2012). The methods applied were: the logical deductive one, insofar as it allowed to analyze the sentence from the general consideration that violations of rights had been alleged in the petition sent to the IACHR, to the facts and individualized evidence that substantiated the responsibility of the State; and the inductive logical method, insofar as it allowed legal professionals to start with general questions, to obtain specific answers regarding the dissemination of knowledge that had been achieved thanks to the jurisprudential precedent analyzed. The results and conclusions can be appreciated by the reader throughout this project. | en_US |
