dc.description.abstractEl Estado Ecuatoriano y los Sistemas Internacionales de Derechos Humanos reconocen el derecho a la vida del que está por nacer o Nacisturus, sin embargo se produce una contraposición de derechos entre este nuevo ser y la madre\; por tal razón, el objetivo del presente trabajo de investigación es analizar la situación jurídica del Nacisturus en el Ecuador su tutela efectiva en los sistemas internacionales de derechos humanos. Se llega a identificar la protección de la vida desde la concepción a nivel nacional e internacional. Mediante el análisis de estudio de casos de la Corte y Comisión Interamericana de Derechos Humanos y la Corte Suprema de San Salvador, además de entrevistas a expertos especialistas, lo que permite tratar directamente el problema de investigación, teniendo como resultados la exposición de ambigüedades en normativas jurídicas y mecanismos de Protección de derechos del Nasciturus en el Ecuador, diagnostico de su situación jurídica en el Ecuador y la influencia del Sistema Interamericano de Protección de Derechos Humanos en tutela efectiva del Nasciturus.
dc.description.abstractThe Ecuadorian State and the International Human Rights Systems recognize the right to life of the unborn or Nacisturus, but there is an opposition of rights between this new being and the mother\; for this reason, the objective of this research work is to analyze the legal status of Nacisturus in Ecuador its effective protection in international human rights systems. It identifies the protection of life from conception to national and international level. Through the analysis of case studies of the Court and the Inter-American Commission on Human Rights and the Supreme Court of San Salvador, in addition to interviews with expert experts, which allows direct treatment of the research problem, resulting in the exposure of ambiguities in regulations legal and mechanisms of Protection of rights of Nasciturus in Ecuador, diagnosis of their legal status in Ecuador and the influence of the Inter-American System for the Protection of Human Rights in effective protection of Nasciturus.en_US
