Análisis comparativo entre los delitos de femicidio y asesinato en la legislación penal ecuatoriana

| dc.description.abstract | Ecuador es uno de los países, en donde se evidencia una cantidad exorbitante de femicidios y asesinatos. En el Ecuador, antes del 2014 no estaba tipificado el delito de femicidio, por ello todas las muertes violentas sin distinción alguna de si la víctima fuera de género femenino o masculino, se lo tipificaba como asesinato o como homicidio ya que estos tipos penales se encontraban formando parte del antiguo Código penal en los artículos 449 y 450 del menciona cuerpo legal. A partir de la promulgación del nuevo Código Orgánico Integral Penal (COIP), en el año 2014, se creó la figura del femicidio y se introdujo el concepto del mismo, el que se encuentra tipificado en el Art. 141 y que manifiesta que la persona que incurra en este tipo penal será sancionada con una pena privativa de libertad de 22 a 26 años, dependiendo de las situaciones agravantes y atenuantes en este caso en particular. En este nuevo Cuerpo Legal también encontramos la figura del tipo penal asesinato que consta en el Art. 140 y que también mantiene ciertas circunstancias que debe reunir para que se pueda tipificar este delito, el cual también mantiene una pena privativa de libertad similar al femicidio. Este cambio ha determinado que la administración de Justicia en este caso la Fiscalía que es la entidad encargada de investigar el ejercicio de la acción pública, sea quien establezca con todos los elementos de convicción cual es el tipo penal que encaja con el cometimiento del delito. Bajo este lineamiento la presente investigación está encaminada a determinar la comparación es decir las semejanzas y diferencias entre el delito de femicidio y asesinato en la legislación Penal Ecuatoriana, con el fin de darnos cuenta que nuestra legislación en tema de violencia contra las mujeres ha ido progresando en la defensa de los derechos. | |
| dc.description.abstract | Ecuador is one of the countries, where an exorbitant amount of femicides and murders is evidenced. In Ecuador, before 2014, the crime of femicide was not classified, therefore all violent deaths without any distinction of whether the victim was female or male, was classified as murder or homicide since these criminal types were found forming part of the old Penal Code in articles 449 and 450 of the mentioned legal body. As of the promulgation of the new Comprehensive Organic Criminal Code (COIP), un 2014, the figure of femicide was created and the concept of femicide was introduced, which is typified in article 141 and which states that the person who incurs in this type of crime will be punished with a custodial sentence of 22 to 26 years, depending on the aggravating and mitigating situations in this particular case. In this new Body of Law, we also find the figure of the murder crime that appears in Art. 140 and that also maintains certain circumstances that must be met in order for this crime to be classified, which also maintains a custodial sentence similar to femicide. This change has determined that the administration of Justice in this case the Prosecutor’s Office, which is the entity in charge of investigating the exercise of public action, is the one who establishes with all the elements of conviction what is the criminal type that fits with the commission of the crime. Under this guideline, this research is aimed at determining the comparison, that is, the similarities and differences between the crime of femicide and murder in the Ecuadorian Criminal legislation, in order to realize that our legislation on violence against women has been progressing in defense of rights. | en_US |
