| dc.description.abstract | Los procedimientos de emergencia son protocolos a seguir, con los cuales se pretende subsanar una determinada circunstancia impredecible. En el Ecuador para el año 2020 se establece un estado de emergencia por la pandemia por COVID-19, alertando a todas sus instituciones para que de manera inmediata se dé paso a los procedimientos de emergencia ya establecidos. Es por esta razón el interés sobre esta investigación titulada Los procedimientos de emergencia para la adquisición de obras, bienes y servicios para atender las necesidades del centro de rehabilitación social de Ibarra entre 2019-2021, cuyo objetivo general fue determinar la eficacia de los procedimientos de emergencia para la adquisición de obras, bienes y servicios para atender las necesidades del centro de rehabilitación social de Ibarra a fin de salvaguardar el cumplimiento de los derechos fundamentales hacia las personas privadas de libertad en épocas de pandemia del COVID-19, para distinguir la actuación del Estado en cuanto a garantizar los derechos de las personas privadas de libertad a través de los procedimientos respectivos y así ofrecer una mejor reinserción social. El método utilizado dentro de esta investigación fue el hermenéutico, con el apoyo del método normativista y deductivo. Los resultados de esta investigación desglosaron el interés del Estado por las personas privadas de libertad y la garantía de sus derechos fundamentales en relación con la pandemia de COVID-19, así también sobre la eficacia de los procedimientos de emergencia. En conclusión, se determinó que el Estado no garantizó los derechos de las personas privadas de libertad, esto por la falta de planificación para la adquisición de obras, bienes y servicios que necesita centro de rehabilitación social de la Ciudad de Ibarra. | |
| dc.description.abstract | Emergency procedures are protocols to be followed, with which it is intended to remedy a certain unpredictable circumstance. In Ecuador for the year 2020 a state of emergency is established for the pandemic by COVID-19, alerting all its institutions so that they can immediately follow the emergency procedures already established. It is for this reason the interest on this research entitled Emergency procedures for the acquisition of works, goods and services to meet the needs of the social rehabilitation center of Ibarra between 2019-2021, whose general objective was to determine the effectiveness of emergency procedures for the acquisition of works, goods and services to meet the needs of the social rehabilitation center of Ibarra in order to safeguard compliance with the fundamental rights towards persons deprived of liberty in times of COVID-19 pandemic, to distinguish the performance of the State in terms of guaranteeing the rights of persons deprived of liberty through the respective procedures and thus provide a better social reintegration. The method used within this research was the hermeneutic method, with the support of the normativist and deductive method. The results of this research broke down the State's interest in persons deprived of liberty and the guarantee of their fundamental rights in relation to the COVID-19 pandemic, as well as the effectiveness of emergency procedures. In conclusion, it was determined that the State did not guarantee the rights of persons deprived of liberty, due to the lack of planning for the acquisition of works, goods and services needed by the social rehabilitation center in the city of Ibarra. | en_US |
