Eficiencia y eficacia de los procesos de la acción extraordinaria de protección en la tutela del derecho a la seguridad jurídica

| dc.description.abstract | En el presente estudio se realiza un análisis de la eficiencia y eficacia en la garantía del derecho a la seguridad jurídica en los procesos de la AEP, el cual se realiza mediante análisis de casos en los que los accionantes han demandado vulneración de derecho a la seguridad jurídica y sobre los cuales la Corte Constitucional ha dictado sentencias aceptándolas o rechazándolas. Para tal efecto se analizan parámetros como el tiempo, el proceso de admisión, la sustanciación de la causa, es decir la revisión del contenido de la sentencia relacionado a la seguridad jurídica y finalmente el seguimiento a la ejecución de las mismas. Del análisis efectuado, se encuentra que el tiempo de la sustanciación de la causa es considerablemente extenso comparado con los 30 días que ordena el artículo 63 de la LOGJYCC, tampoco hay suficientes evidencias que permitan determinar el estado del seguimiento a la ejecución de las sentencias; mientras que el proceso de sustanciación en sí mismo, relacionado con contenido de las sentencias, tiene un amplio y rigurosos análisis sobre el derecho vulnerado previo a tomar la decisión. Éste se desarrolla de manera organizada, a través de la formulación y desarrollo de problemas jurídicos con métodos interpretativos que permiten llegar a decisiones claras. Por lo anterior, se puede concluir que la Acción Extraordinaria de Protección, con excepción del tiempo y el seguimiento a la ejecución, es en buena medida eficiente y eficaz en la protección del derecho a la seguridad jurídica, toda vez que las decisiones son profundamente analizadas y argumentadas. | |
| dc.description.abstract | In the present study is done an analysis of the efficiency and effectiveness in the guarantee of the right to legal security in the processes of Extraordinary Action of Protection. This is done through analysis of cases in which the applicant had demanded a violation of the right to security legal and on which the has issued sentences accepting or rejecting them. For this purpose, some parameters are analyzed. This are time, the admission process, the substantiation of the case, the review of the content of the sentence related to legal certainty and finally the follow-up to the execution of the Constitutional Court decision. From the analysis carried out, it is found that the time of substantiation of the case is considerably extensive compared to the 30 days ordered by article 63 of the LOGJYCC. There is not sufficient evidence to determine the grade of the follow-up to the execution of the sentences, but probably the effectiveness is low. The process of substantiation in itself, related to the content of the sentences, has a comprehensive and rigorous analysis of the right violated prior to making the decision. The substantiation is developed in an organized way, through the formulation and development questions about legal problems with interpretive methods that allow to reach clear decisions. Based on this analysis it can be concluded that the Extraordinary Action of Protection, with the exception of time and follow-up on execution, is largely efficient and effective in protecting the right to legal security, because the process and decisions Constitutional Court are deeply analyzed and argued. | en_US |
