| dc.description.abstract | La presente investigación presenta como objetivo general analizar si existe una adecuada reparación integral a la víctima en los delitos de tránsito por muerte culposa en el cantón Ibarra en el año 2020. Para lo cual se planteó la metodología en la que se utilizó el método deductivo, ya que esta metodología va de lo general a lo particular y es lo que se ha venido realizando en la presente investigación. Las técnicas utilizadas dentro de la investigación son las entrevistas que se realizaron a jueces y fiscales de Ibarra, por otro lado, se utilizó la técnica documental, analizando y procesando la información con la cual la revisión y análisis documental de sobre delitos de muerte culposa, sentencias sobre reparación integral emitidas por la Corte Interamericana de Derechos Humanos, para de tal forma obtener resultados necesarios y con fundamento para aportar información de la investigación. De la misma forma, se utilizó la técnica de análisis de contenido de datos estadísticos acerca de accidentes con resultado de muerte culposa a nivel nacional y a nivel de la ciudad de Ibarra, mismo que fue emitido por la Fiscalía Provincial de Imbabura. Los mecanismos para hacer efectiva la reparación integral a la cuales tiene derecho las víctimas indirectas en delitos por muerte culposa por accidente de tránsito, que tiende a satisfacer los daños materiales e inmateriales causados por la infracción; además, se analiza la motivación invocada para la cuantificación, a fin de establecer si existe una adecuada reparación integral a las víctimas. Puesto que esto nos llevó a la conclusión de que el derecho a una reparación integral que incluye el mecanismo de indemnización, sin embargo, no existen mecanismos legales para hacerla efectiva exceptola suspensión de la pena cuando se la solicita por parte del procesado y la acción de ejecución de la sentencia. | |
| dc.description.abstract | The present investigation presents as a general objective to analyze if there is an adequate comprehensive reparation to the victim in traffic crimes due to wrongful death in the Ibarra canton in the year 2020. For which the methodology was proposed in which the deductive method was used, since this methodology goes from the general to the particular and it is what has been carried out in the present investigation. The techniques used in the investigation are the interviews that were conducted with judges and prosecutors of Ibarra, on the other hand, the documentary technique was used, analyzing and processing the information with which the review and documentary analysis of crimes of wrongful death, sentences on comprehensive reparation issued by the Inter-American Court of Human Rights, in order to obtain the necessary results and with the basis to provide information on the investigation. In the same way, the statistical data content analysis technique was used on accidents resulting in wrongful death at the national level and at the level of the city of Ibarra, which was issued by the Imbabura Provincial Prosecutor's Office. The mechanisms to make effective the integral reparation to which the indirect victims in crimes due to wrongful death due to traffic accidents are entitled, which tends to satisfy the material and non-material damages caused by the infraction; In addition, the motivation invoked for the quantification is analyzed, in order to establish if there is adequate comprehensive compensation for the victims.
