Análisis jurídico del incumplimiento del pago de pensiones alimenticias en el cantón Ibarra en el período (2022-2023)

| dc.description.abstract | El estudio titulado “Análisis jurídico del incumplimiento del pago de pensiones alimenticias en el Cantón Ibarra, Período 2022-2023” se centró en examinar la eficacia del marco legal actual respecto al cumplimiento de las pensiones alimenticias. El Cantón Ibarra ha enfrentado retos significativos en esta materia, particularmente durante el periodo de análisis. La investigación tuvo como eje principal la identificación de las causas del incumplimiento y la evaluación de las medidas legales disponibles para enfrentar este problema. La metodología empleada fue de carácter cualitativo, basándose en el análisis socio jurídico a través de la revisión de casos documentados y entrevistas con actores clave en el sistema de justicia familiar. Se revisaron datos de instancias judiciales y se entrevistó a profesionales del derecho y a partes afectadas para obtener un panorama completo de la situación. Los hallazgos revelaron que, a pesar de existir un marco normativo adecuado para asegurar el pago de pensiones alimenticias, la aplicación práctica de las leyes es insuficiente. Se identificaron obstáculos significativos, como la falta de recursos en el sistema judicial, la insuficiente ejecución de sanciones y la falta de educación legal en la población afectada. La gestión de la problemática corresponde principalmente a los juzgados de familia y a los organismos de protección de derechos, los cuales deben operar en coordinación con otras entidades gubernamentales. Sin embargo, la investigación apuntó a la necesidad de una mayor integración y cooperación entre las distintas instituciones involucradas, del mismo modo, se determinó que el régimen jurídico actual para el manejo de las pensiones alimenticias en el Cantón Ibarra es ineficaz para asegurar el cumplimiento de estas obligaciones. Se destacó la importancia de implementar mejoras los mecanismos de ejecución y fomentar la educación legal para enfrentar el incumplimiento de las pensiones alimenticias. | |
| dc.description.abstract | The study titled Legal analysis of non-compliance with the payment of alimony in the Ibarra Canton, Period 2022-2023” focused on examining the effectiveness of the current legal framework regarding compliance with alimony. The Ibarra Canton has faced significant challenges in this matter, particularly during the period of analysis. The focus of the investigation was the identification of the causes of non-compliance and the evaluation of the legal measures available to address this problem. The methodology used was qualitative in nature, analyzing socio-legal analysisthrough the review of documented cases and interviews with key actors in the family justice system. Data from judicial instances was reviewed and legal professionals and affected parties were interviewed to obtain a complete picture of the situation. The findings revealed that, despite there being an adequate regulatory framework to ensure the payment of alimony, the practical application of the laws is insufficient. Significant obstacles were identified, such as the lack of resourcesin the judicial system, the insufficient execution ofsanctions and the lack of legal education in the affected population. The management of the problem corresponds mainly to family courts and rights protection organizations, which must operate in coordination with other government entities. However, the investigation pointed to the need for greater integration and cooperation between the different institutions involved, in the same way, it is accepted that the current legal regime for the management of alimony in the Ibarra Canton is ineffective to ensure compliance with these obligations. The importance of implementing improvements in enforcement mechanisms and promoting legal education to address non-compliance with alimony was highlighted. | en_US |
